SC seeks response of Centre, states on violation of Right to Education Act

Petition asked the states and the UTs to recruit and train one lakh additional professionally trained teachers every month.
   
The PIL, filed by the National Coalition for Education — a network of organisations fighting for the RTE — said at least 1.5 lakh schools and 12 lakh trained teachers were required to fulfill the goals envisaged under the RTE.

 It sought a direction that "the states and UTs upgrade all deficient schools with appropriate physical infrastructure so as to be in compliance with the RTE Act within six months.

"The states and UTs regularise and make permanent all contract and para-teachers in the country," it said. The petition also said the states and UTs should disclose the number of students admitted under the Economically Weaker Section (EWS) quota in the state in accordance with the provisions of the Act. 


 
A bench headed by Chief Justice P Sathasivam issued notice and sought their response after summer vacation on a plea filed by an organisation, National Coalition for Education.
  
The plea said lack of resources and failure to implement provisions of the RTE Act has resulted in a significant decline in education performance.
  
Senior advocate Colin Gonsalves sought a direction to all the states to complete the required neighbourhood mapping within six months and new schools be constructed six months after completion of the process.
  
The petition asked the states and UTs to recruit and train one lakh additional professionally trained teachers to end the shortage of educators within a year.
  
It sought a direction that "the states and UTs upgrade all deficient schools with appropriate physical infrastructure so as to be in compliance with the RTE Act within six months.

The petition also said the states and UTs should disclose the number of students admitted under the Economically Weaker Section (EWS) quota in the state in accordance with the provisions of the Act.
  
"Based on the aforementioned facts, it is clear that the Right to Education is being violated across the country. These violations have persisted for years and remain today in face of the RTE Act's requirement that they be remedied within three years of it coming into force.
  
"And more troubling, they persist despite widespread awareness of their existence by various responsible governments and authorities and in the face of previous orders from this court on October 3, 2012 to remedy them," it said

याचिकाकर्ता ने लगाया है शिक्षा का अधिकार कानून के उल्लंघन का आरोप 

नई दिल्ली (ब्यूरो)। देशभर के स्कूलों में शिक्षकों और संसाधनों की कमी के चलते शिक्षा के अधिकार कानून (आरटीई) के उल्लंघन के आरोप पर सुप्रीम कोर्ट ने शुक्रवार को केंद्र व सभी राज्य सरकारों से जवाब तलब किया। सर्वोच्च अदालत में दायर याचिका में इस कानून पर सही तरीके से अमल कराने के लिए सरकारों को निर्देश जारी करने की मांग की गई है।
चीफ जस्टिस पी. सदाशिवम की अध्यक्षता वाली पीठ ने केंद्र, राज्य व केंद्र शासित प्रदेशों को नोटिस जारी कर ग्रीष्मावकाश के बाद जवाब दाखिल करने को कहा है। याचिका नेशनल कोलीशन फॉर एजुकेशन संगठन ने दायर की है। याचिका में कहा गया है कि संसाधनों की कमी और आरटीई के प्रावधानों को लागू करने में विफलता के कारण शिक्षा के क्षेत्र में काफी गिरावट आई है। पीठ के समक्ष वरिष्ठ अधिवक्ता कोलिन गोंसाविस ने सभी राज्यों को छह महीने के भीतर दूर-दराज के इलाकों का अध्ययन करने का निर्देश जारी करने का आग्रह किया। साथ ही कहा कि यह प्रक्रि या पूरी होने के बाद छह महीने के लिए नये स्कूलों का निर्माण होना चाहिए।

Rubbishing the allegations of "irregularities" in primary Teacher Eligibility Test (TET) examinations, the West Bengal School Service Commission (SSC ) chief asserted that the panel was "transparent" and "fair" in its discharge of duties, as per news reports.

SSC deputy chairman Amitesh Biswas had on Monday accused the commission of offering jobs to candidates who had scored less in the eligibility test while denying the same to deserving candidates.

Rubbishing Biswas's claims, panel chairman Subiresh Bhattacharya said, "The commission works in a transparent way and if someone is alleging that there are irregularities, then it is their responsibility to substantiate it with proof. But, if someone is trying to malign the commission, we will take appropriate action."

Bhattacharya clarified that only deserving candidates have got jobs and there is no diversion in the functioning of the commission.

Training his guns on Biswas who was relieved of his duties following the allegations, Bhattacharya said the official never lodged a formal complaint regarding this matter.

"I would request him to send a written letter to the commission. However, if his allegations are found to be baseless, then appropriate action will be taken within the purview of law," the panel head said.

Despite being relieved of his responsibilities, Biswas on Tuesday forced his way into the office, contending his removal was illegal.

"Chairman (Bhattacharya) is not empowered to order my removal. Moreover, I am the custodian of very important documents that are here in the office. It is my responsibility to protect those," said Biswas.

West Bengal Teachers Eligibility Test (TET) is rescheduled for March 30, 2014.  This examination was supposed to be conducted on March 9. 2014 but were postponed for delay in the receipt of the application forms.

West Bengal Board of Primary Education is conducting WBTET. TET pass certificate will also be issued by this board. Examination conducts for the recruitment of Primary School teachers. As per the guidelines issued by NCTE, candidates will be appointed as primary school teachers based on the TET examination.

West Bengal Government had given approval for the candidates to reappear for the examination even after clearing WBTET 2012 for improved marks. Candidates who were willing to appear for the second time for this examination should provide information to the board through the website of West Bengal Board of Primary Education.

In 2012, several candidates had written the examination and passed the same. But they were willing to appear for the examination to improve their marks. West Bengal Government had given approval for the candidates who were willing to re-write their exams for score imporvement.

Such candidates are required to give information compulsorily, which will lead to confirmation about their candidature for the Second TET. APPOINTMENT NOTIFICATION FOR PRIMARY TEACHERS 

Applications are invited for the posts of Assistant Teachers in the Govt. Aided/Sponsored Primary/Junior Basic Schools under the District Primary School Council / Primary School Council to fill up the vacancies as mentioned below. The rules of the Teacher Eligibility Test
(TET) and other particulars are stated in the following paragraphs. A candidate should verify from the notified rules vide No. 285-SE(EE)/P/10M-6/09(pt.) dated 24.07.2012 (www.wbsed.gov.in) that he/she is eligible for the TET as mentioned below:

1. Scale of Pay: Rs. 5400-Rs.25200/- + Grade Pay as admissible. Besides pay, the posts carry allowances as admissible. 
2. Qualification: (a) Citizenship of India or such other nationalities as are declared eligible by Government of India; or (b) Higher Secondary pass under the West Bengal Council of Higher Secondary Education or its equivalent with at least 50% marks and 2-year
Diploma in Elementary Education (by whatever name known); or (c) Higher Secondary pass under the West Bengal Council of Higher Secondary Education or its equivalent with at least 45% marks and 2-year Diploma in Elementary Education (by whatever name
known), in accordance with the National Council for Teacher Education (Recognition Norms and Procedure) Regulations 2002; or (d) Higher Secondary pass under the West Bengal Council of Higher Secondary Education or its equivalent with at least 50% marks and
Diploma in Education (Special Education); or (e) Graduation and two year Diploma in Elementary Education (by whatever name known); or (f) Ability to read, write and speak in the language relating to the medium for which the candidate wishes to apply.
Note 1. – A person with D. Ed. (Special Education) or B. Ed. (Special Education) qualification shall, after appointment, undergo six month special programme in Elementary Education recognized by the NCTE.
Note 2. – The persons having qualification of Higher Secondary pass under the West Bengal Council of Higher Secondary Education or its equivalent with at least 50% marks or graduate (irrespective of marks obtained therein) or equivalent without 2-year Diploma in
Elementary Education (by whatever name known) or 4-year Bachelor of Elementary Education (B. El. Ed.) or 2-year Diploma in Education (Special Education) shall also be eligible for appearing in the Teacher Eligibility Test (TET) to be conducted for appointment of
primary school teachers in the State upto 31
st
 March, 2014, subject to condition that those who are appointed without professional qualification shall acquire the professional qualification within a period of two (2) years from the year of appointment.
Provided that in case of Santhali as medium of instruction, the candidate shall only require to possess proficiency of reading, writing and speaking in OLCHIKI SCRIPTS. It shall not be obligatory for the candidates seeking appointment to the post of primary school
teacher in Santhali medium schools to have passed in the specific language as the first or the second language in the Higher Secondary Level or equivalent for which medium of instruction, the candidate is seeking appointment.
Candidates belonging to reserved categories SC/ST/OBC/PH/EC shall be allowed relaxation upto 5% in the qualifying marks.
3. Age: Not less than 18 years and more than 40 years as on 01.01.2012. Relaxation of upper age for the reserved category and Exempted Category candidates shall be as per the existing Rules of the State Government.
4. Manner of Selection: (a) The Teacher Eligibility Test (TET) shall be held as per guidelines issued from time to time by the National Council for Teacher Education and a person who will score 60% or above in the Teacher Eligibility Test (TET) examination shall be 
considered as Teacher Eligibility Test (TET) pass provided relaxation upto 5% marks shall be allowed to the candidates belonging to the reserved categories, such SC/ST/OBC/PH/EC.
(b) Teacher Eligibility Test (TET) examination shall be held in 100 marks consisting of the following five (5) Sections;
(a) Section I – Child Development – 20 Marks
(b) Section II – Language I – 20 Marks
(c) Section III – Language II – 20 Marks
(d) Section IV – Mathematics – 20 Marks
(e) Section V – Environmental Science – 20 Marks

Note 1. – All questions shall be of multiple choice types with four alternatives out of which one option will be correct. All questions shall be compulsory and each item shall carry one mark. But there will be no negative marking.
Note 2. – First Language of the candidate shall be determined as per the medium of instruction of the primary school for which the vacancy occurred and Second Language be English.
(c)  The Selection Committee shall call all Teacher Eligibility Test (TET) qualified candidates as mentioned in sub-rule (2), for the Viva-Voce/interview. The performance of the candidates who will be called for Viva-Voce/interview shall be assessed out of 10 marks by the interview Board formed for the specific purpose. 
(d) Thereafter, academic, training, performance in Teacher Eligibility Test (TET), Extra Curricular Activities and performance in Viva-Voce/interview of the candidates appeared at the Viva-Voce/interview shall be computed in the following manner as mentioned in Table 
A below:-

(iii) Training as prescribed in sub-rule (2) of rule 6 20

 Note 1. – The percentage of marks to the total full marks obtained by the candidate in the Madhyamik Examination or its equivalent excluding additional marks, if any, shall be computed as percentage of 10.
Note 2. – The percentage of marks to the total full marks obtained by the candidate in the H.S. Examination or its equivalent excluding additional marks, if any, shall be computed as percentage of 15.
Note 3. – 70% and above marks obtained by the candidate in Training shall be awarded 20, 50% above but below 70% marks obtained by the candidate in Training shall be awarded 17 and below 50% marks but passed in the Training by the candidate shall be
awarded 15.
Note 4. – The percentage of marks to the total full marks obtained by the Teacher Eligibility Test (TET) qualified candidate in Teacher Eligibility Test (TET), shall be computed as percentage of 40.
Note 5. – Maximum five (5) Marks shall be awarded to the candidates in the Extra Curriculum Activities on the following Extra Curriculum Activities:-

1 Games and Sports 1
2 National Cadet Corps (NCC) 1
3 Arts and Literature 1
4 Performing Art (Drama) 1
5 Music 1
Total 5

(a) A certificate of representation in the State/National/International level Games or Sports issued by the Competent State Govt. or Central Government Authorities or agencies, shall be awarded (01) mark.
(b) Minimum ‘A’ certificate of National Cadet Corps (NCC) shall be awarded (01) mark.
(c) A certificate that any essay, story, short story, drama, poetry written by the candidate selected for publication in State Level or National newspaper or Magazine (Certificate along with a copy of publication shall be submitted), shall be awarded (01) mark.
(d) A certificate that the candidate has obtained proficiency in Performing Art (drama) issued by National School of Drama or by the State Government or Central Government shall be awarded (01) mark.
(e) A certificate that the candidate has obtained proficiency in Music or Instrumental Music issued by the State Government or Central Government shall be awarded (01) mark

5. Teacher Eligibility Test (TET) will be conducted by the Board on a single day throughout the State of West Bengal.

KOLKATA: The year-long wait of the would-be school teachers in the state finally ended on Tuesday with the School Service Commission declaring the results of the Teacher Eligibility Test written examination. A total 36,590 students qualified for the last round of personality test.

As many as 9,826 posts, mainly in science subjects, will remain vacant because there are not enough candidates who could qualify the second round of Teacher Eligibility Test (TET). SSC authorities will have to make a fresh advertisement for filling up the vacant posts in state-run schools. Those who could make it to the final round after a protracted legal battle will be called for the five-mark interview from August 20. Education minister Bratya Basu said that the government that


"We will be able to provide employment to more than a lakh candidates within the year combining the teaching and non-teaching posts. We expect to publish the results of primary TET examinations within a few months. It will create another 50,000 jobs in the state primary schools. All these, along with the recruitment in state universities, will exceed the one-lakh job mark that chief minister Mamata Banerjee had promised," the education minister said.

A little embarrassed with the poor performance in science subjects, the education minister blamed it on the Left Front government's faulty policy. "This is not unique. You will find many such candidates unable to qualify the TET in the preceding years. The Left Front's faulty education policy has weakened the scientific temper among students," Basu said.

Among the 9,826 posts which could not be filled, around 60% belongs to the SC/ST category. "The highest number of positions lying vacant is in mathematics in which around 2,000-2,500 posts could not be filled. The other subjects in which vacant posts remained are Economics, Bio-Sciences, Physics and Chemistry.

Majority of the candidates, who could not become eligible, are from the science stream," said chairman of the West Bengal School Service Commission Chittaranjan Mondal. The delay in publishing the result by a year was attributed to the pending court cases.
